Itinerant live-aboard boaters are carrying on their legal challenge of the Canal & River Trust’s unlawful harassment of boat dwellers without home moorings. Following refusal of permission to bring a Judicial Review of the Guidance for Boaters Without a Home Mooring, liveaboard boater Nick Brown confirmed that he is to appeal. “The judgement contains at least 20 errors in law”, said Brown, who is an officer of the National Bargee Travellers Association. The Guidance was published by BW in October 2011 and incorporated into the Licence Terms and Conditions.
The judgement refusing permission was handed down by Mrs Justice Cox in the High Court on 16th November. The case continues.
